New revenue streams found for radio broadcasters
bonus for lawyers

Lawyers for NRJ Group have now filed a lawsuit against RTL France seeking damages from the Fun Radio escapade earlier this year, reported Les Echos and AFP (December 20). Other French national radio broadcasters are expected to join the legal action, as they have previously threatened. Fun Radio was sanctioned by measurement institute Médiamétrie for interfering with radio audience surveys when morning show host Bruno Guillon referenced the surveys on-air and suggested fans be untruthful if contacted by interviewers. After its own investigation, Médiamétrie de-listed Fun Radio results for the spring and summer 2016 periods.

Details from the NRJ Group filing have not been publicly disclosed. An unnamed Skyrock spokesperson indicated to AFP losses resulting from the Fun Radio publicity stunt, referred to as “monstrous fraud,” might have been €10 million. Thereafter, Les Echos estimated total damages sought by complainants in the vicinity of €50 million if all choose to assemble their lawyers. (See more about media in France here)

RTL France succeeded in having the audience estimates for Fun Radio reinstated by taking Médiamétrie to court. The company has steadfastly denied any “fraud” and has accused the complainants of attempting to “destabilize the company.” In June RTL France lodged a defamation complaint against NRJ Group chairman Jean-Paul Baudecroux, Lagardère Active president Denis Olivennes and NextRadioTV president Alain Weill. RTL Group announced in mid-December intentions to merge radio company RTL France with TV company M6 Group.
